Welcome to Garden Maintenance Blackwall. By engaging with our services, you agree to the following Terms and Conditions. Please read them carefully.
1. Definitions
- Client: The individual or organization purchasing our services.
- Services: All garden maintenance tasks provided by Garden Maintenance Blackwall, including but not limited to lawn care, pruning, planting, and general upkeep.
- Agreement: The contractual agreement between the Client and Garden Maintenance Blackwall outlining the scope of services and terms.
2. Scope of Services
Our garden maintenance services encompass a wide range of tasks designed to keep your garden healthy and aesthetically pleasing. These services include:
- Regular lawn mowing and edging
- Pruning and trimming of shrubs and trees
- Planting and mulching
- Weeding and pest control
- Seasonal garden clean-up
3. Service Scheduling
Services are scheduled based on mutual agreement between the Client and Garden Maintenance Blackwall. We strive to accommodate the Client's preferred schedule; however, availability cannot be guaranteed during peak seasons.
3.1. Rescheduling and Cancellations
The Client may reschedule or cancel a service appointment by providing at least 48 hours notice. Failure to do so may result in a cancellation fee.
4. Payment Terms
Payment for services is due upon completion unless otherwise agreed upon in the Service Agreement. We accept various payment methods, including cash, credit card, and bank transfers.
4.1. Late Payments
Late payments may incur a fee of 5% of the outstanding amount per week. Continuous late payments may result in suspension of services until the account is settled.
5. Client Responsibilities
The Client agrees to:
- Provide access to the property during scheduled service times.
- Communicate any specific requirements or concerns regarding garden maintenance.
- Ensure that the garden area is free of hazards that may impede the provision of services.
6. Liability
Garden Maintenance Blackwall is committed to providing high-quality services. However, we are not liable for any pre-existing conditions or damages caused by unforeseen circumstances. The Client is responsible for informing us of any known issues within the garden area before services commence.
6.1. Insurance
We maintain comprehensive insurance to cover any accidental damages during the provision of services. Copies of insurance certificates can be provided upon request.
7. Termination of Services
Either party may terminate the service agreement with a written notice of 30 days. All outstanding payments for services rendered up to the termination date must be settled.
7.1. Immediate Termination
Garden Maintenance Blackwall reserves the right to terminate services immediately if the Client engages in fraudulent activities, fails to pay due fees, or poses a safety risk to our staff.
8. Changes to Terms and Conditions
We reserve the right to modify these Terms and Conditions at any time. Clients will be notified of significant changes via email or through our official communication channels. Continued use of our services after such modifications constitutes acceptance of the new terms.
8.1. Notification
Notifications of changes will be provided at least 14 days prior to implementation. Clients are encouraged to review the Terms and Conditions regularly.
9. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the jurisdiction in which Garden Maintenance Blackwall operates. Any disputes arising from this agreement will be subject to the exclusive jurisdiction of the local courts.
10. Privacy Policy
We prioritize the privacy of our Clients. Any personal information collected during the provision of services will be handled in accordance with our Privacy Policy. Information will not be shared with third parties without explicit consent unless required by law.
10.1. Data Protection
All data collected is stored securely and only accessible to authorized personnel. Clients have the right to request access to their personal data and request corrections if necessary.
11. Force Majeure
Garden Maintenance Blackwall is not responsible for delays or failures in service delivery caused by circumstances beyond our control, including but not limited to natural disasters, extreme weather conditions, or unforeseen events.
11.1. Notification of Force Majeure
In the event of a force majeure situation, we will notify the Client as soon as possible and make every effort to resume services promptly once the situation has been resolved.
12. Entire Agreement
This document constitutes the entire agreement between the Client and Garden Maintenance Blackwall. It supersedes any prior agreements, understandings, or representations, whether oral or written.
12.1. Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
13. Acceptance of Terms
By engaging our services, the Client acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.
